Here at FlatHomes, we're taking a look back at the Renting Homes (Wales) Act. It's been over two years since this big change, and we've learned a lot about how it's shaping renting for everyone in Wales!
The Renting Homes (Wales) Act completely changed how renting works here in Wlaes. It replaced all the old tenancy agreements with something new called "occupation contracts." This was designed to make things simpler, but for us at FlatHomes, it meant a lot of learning and updating our processes!
Key Changes We've Seen
One of the biggest shifts was introducing "secure contracts" for social housing and "standard contracts" for private rentals. Plus, those "no-fault" eviction notice periods for new contracts went from two months to a full six months. It’s a significant change that gives contract-holders more security.
Another huge focus of the Act is making sure properties are "fit for human habitation." This covers everything from ensuring proper smoke and carbon monoxide alarms are fitted to regular electrical safety checks. As your propert managers, FlatHomes works closely with landlords to make sure all properties meet these important standards.
The past two years have been a busy but rewarding time. We quickly got our team up to speed, updated all our paperwork, and helped our landlords understand their new responsibilities. The extended notice periods and the emphasis on property standards have been the most noticeable changes, and we've seen many landlords reaching out for advice on making their properties 'fit for human habitation'.
A Recent Reminder: Electrical Safety Matters!
We saw a recent court ruling that really highlighted how important it is to provide Electrical Installation Condition Reports (EICRs) quickly. If these aren't given on time, a property could be seen as "unfit," which can even affect a landlord's right to collect rent. It's a clear message that keeping accurate records and staying on top of property maintenance is key!

- Proactively schedule maintenance to keep properties compliant.
Still Learning and Adapting
Even with all the progress, some parts of the Act still lead to discussions. For example, figuring out exactly what "fitness for human habitation" means for every unique, older property can be a bit tricky as the Act remained somewhat open for interraption without clear guidance.
The new rules have also meant a bit more paperwork for us. While the Act aims for simplicity, preparing detailed written occupation contracts and delivering all the necessary documents on time certainly add to the adminsitrive nature of property management. Good News for Landlords: Compensation Scheme Rejected
You might have heard about a proposal for landlords to pay compensation to tenants when issuing "no-fault" eviction notices (Section 173). We're pleased to share that the Welsh Government decided not to go ahead with this! Industry bodies like Propertymark strongly opposed it, arguing it could discourage landlords and reduce the number of available rental homes.
This decision shows that the Welsh Government understands the importance of keeping a good balance in the private rented sector. At FlatHomes, we believe it's essential for landlords to feel confident and secure in their ability to manage their properties effectively.
